TCS - Terms and Conditions of Sale

ARTICLE 1: INTRODUCTION

The general terms and conditions of sale detailed below (hereinafter referred to as the "General Terms and Conditions of Sale") govern the contractual relations between any user of the site (hereinafter referred to as a "User" or "You") and the simplified joint stock French Crime (hereinafter referred to as "French Crime" or "We").

These General Terms and Conditions of Sale are the only applicable ones and replace all other conditions, unless otherwise agreed in advance, expressly and in writing. French Crime may from time to time modify some of the provisions of its General Terms and Conditions, so it is necessary that they be reviewed before each visit to the site. These modifications are enforceable from the time they are put online and cannot apply to contracts concluded previously. Each purchase on the site is governed by the General Conditions applicable on the date of the order. The fact of indicating that you validate your order automatically implies the acceptance of our General Conditions.

In the following, the term "Website" refers to the website www.frenchcrime.com .

By accessing the Website, you agree to comply with the General Terms and Conditions and any Terms of Use set out therein.


ARTICLE 2: PRICE

The sale prices indicated on the Website are in euros and include all taxes including VAT.

We reserve the right to modify our prices at any time but we undertake to apply the rates in force which will have been indicated to you on the Website at the time of your order.


ARTICLE 3: ORDERS

Orders are placed exclusively on the Internet via the Website. Access to the service is ensured on a permanent basis subject to maintenance and upkeep periods, server updates and any exceptional interruptions.

French Crime provides access to fictional police investigations on its Website.
The customer chooses the method of acquiring his product on the Website.

You will receive an order confirmation email once your payment has been approved.

In the case of a lifetime subscription called "BLOODY STAR Offer", you have unlimited access to existing investigations and to any new investigations that will be published later, for the entire duration of the Website's existence.

Contractual information is presented in the language of the Website and is subject to approval when ordering. French Crime reserves the right to cancel or refuse any order from a customer following the intervention of a payment incident relating to a previous order or when the information transmitted by the User is clearly incorrect.


ARTICLE 4: CONFIRMATION

You declare that you have read and accepted these General Terms and Conditions of Sale before placing your order. The confirmation of your order therefore implies acceptance of these General Terms and Conditions of Sale. Unless there is evidence of fraud on the part of French Crime, the data recorded by French Crime constitutes proof of all transactions between French Crime and You.


ARTICLE 5: AVAILABILITY

Our product offers and prices are valid as long as they are visible on the Website.

ARTICLE 6: RIGHT OF WITHDRAWAL

PURCHASE OF AN INVESTIGATION OR OFFER FOR "My Account"

The User waives his right of withdrawal for these purchases, the investigation or offer being available immediately after the order.


PURCHASE OF A GIFT CARD

A gift card whose code has not been used can be refunded within 30 days of purchase. To use your right of withdrawal, send an email from the email address indicated on the order to contact[at]frenchcrime.com specifying the order number and the item to be refunded.
A gift card whose code has been used cannot be refunded, as the investigation or offer is available immediately after the code is activated.

ARTICLE 7: SECURE PAYMENT

French Crime processes payments through its partner Paypal, a secure online credit card payment solution.
Stripe currently offers all the features necessary to manage a secure payment service on the Internet. The integrity of the exchanged data is ensured by the exchange procedure and the sealing of messages by the use of SSL and SET technologies.

Their use does not require prior downloading of specific software onto your hard drive. The system transmits to our partners' servers the response codes in accordance with ISO IS 8583, and in the case of an agreement, a receipt is provided to both parties, the customer and the online merchant. This electronic receipt is used to validate the existence of the payment at the request of each party.


ARTICLE 8: RESPONSABILITY

This contract is subject to French law. French Crime cannot be held responsible for the non-performance of the contract concluded, on the one hand in case of force majeure and on the other hand, when the non-performance is due to one of its partners. In the latter case, the User is free to seek the responsibility of the defaulting partner.

ARTICLE 9: APPLICABLE LAW - DISPUTES

This contract is subject to French law. The language of this contract is the French language. In the event of a dispute, the search for an amicable solution will be preferred. Failing this, the courts of Grenoble (France) have sole jurisdiction. In other cases, the competent court shall be designated in accordance with the applicable rules of public policy jurisdiction.

ARTICLE 10: PROTECTION OF PERSONAL DATA

In accordance with the French law "Informatique et Libertés", the processing of your information will be the subject of a declaration to the Commission Nationale de l'Informatique et des Libertés (CNIL).

You have a permanent right of access and rectification on all data concerning you, in accordance with European texts and national laws in force (article 34 of the law of 6 January 1978). You can modify your data at any time and on request by sending us a letter to the following address:

French Crime is the sole holder of your information. However, if you have expressly agreed to this when you register on the Website, we may transmit your data to our business partners for the purpose of prospecting. In the event of your acceptance, French Crime may send you information as part of specific and punctual promotional operations.


ARTICLE 11: RIGHTS OF USE

The products are protected by international copyright and intellectual property regulations and treaties. They are the exclusive property of their publishers. This contract confers a right to use a service offered by French Crime. Under no circumstances does it entail the transfer of reproduction, representation, exploitation rights and, more generally, any intangible rights recognized or to be recognized that have contributed to the creation of this product.
